Recent Legislative Changes

Having a legal issue is generally stressful. These days it is more difficult during social distancing, isolation and the anxiety of the pandemic in New York to even think about estate planning, but there are some changes to the laws that may affect you now, or in there near future.

The Governer has issued executive orders that allow for completion of legal documents by videoconferencing. If you need a Will, Power of Attorney or Health Care Proxy, it is possible for us to complete those with you over a video call, from your home, and we can witness from our homes. If you need these documents, or want to update documents, give us a call, we can get it done.

There have also been significant changes to the home care Medicaid program in New York. It is of utmost importance to plan ahead. After October 2020 there will be a lookback and transfer penalty for home care, which we currently do not have. If you or your loved ones have been thinking about applying for services, do it now. If you are over 65, own a home or some non qualified assets, you should consider an asset protection trust now.
